CA and work within last six months
Tue 21-Jul-09 02:30 PM

Hello all

I have a client who is trying to claim Carer's Allowance, but has been told by CA that they need to contact her previous employer to get her last wage slip because she left work less than six months ago. CA have told client that had she left work more than six months ago, they would not have to do this. The employer has not supplied last wage slip to CA despite their requests. I can find no info relating to CA and leaving work less than six months ago. Can anyone throw any light on this, and where my client goes from here.

Sounds a bit off to me.

Earnings in one week affect entitlement to CA in the following week; SS (ICA) Regs, reg 8(1). So what earnings within the last 6 months has to do with anything is a mystery to me.

Has she actually submitted the claim? if so, then appeal against any disallowance. Otherwise get a claim in, if she isn't employed, then she has no requirement to supply past earnings details.

It's probably just to confirm the date she left - perhaps!

Write to the M.P., and ask them to write to the employer requesting that the final wage-slip be reproduced and forwarded on to the C.A. Unit forthwith. A letter from the M.P. always makes people act quickly.
