Tax Credit Overpayment

Hi all

I have a client who has a tax credit overpayment from 2007/08. On 06/07/07 client told HMRC she had separated from her partner on 14/06/07, the joint claim was ended and client claimed CTC from 15/06/07 as a lone parent.

At the end of the financial year, the client returned her annual declaration but the ex-partner didn't. Client has no idea where the ex-partner is and has hardly spoken to him since they separated.

HMRC are now saying that CTC client received from 06/04/07 to 14/06/07 is now an overpayment and must be paid back. HMRC are saying that client didn't meet her responsibilities as both declarations weren't returned!! No amount of arguing etc will get HMRC to budge.
I just seem to be going around in circles with HMRC and would appreciate any hints/tips/advice on how to move this forward.

I'm assuming that you've complained and that the complaint has been dealt with by the customer service and support group at TCO.

Once you've had the final letter in the complaint i'd take this to the Adjudicators Office - it's plainly not fair and any O/P needs to be collected from the other party and not your client who has met all of her responsibilities.

It's worth a try.
