ESA WCA report and DLA appeal

Hi all,

I have a client who was appealing against decisions to refuse both ESA and DLA. ESA decision was earlier and that has been to appeal already. We couldn't attend to rep but produced a submission and the GP provided probably the most helpful/supportive letter ever, but appeal upheld the decision not to award. Currently awaiting SofR.

In the meantime I have received the DLA bundle, which contains a copy of the ESA medical report. Now I've always advised clients the two benefits are not officially related and can't recall ever seeing a medicak report for one directly linked to a claim for the other (though I have always assumed some kind of informal link probably exists). Has anyone else come across this? Clients DLA appeal listed for next month and am wondering if there is any way to object to the presence of the ESA report? Although I know the forms say clients consent to info being used by other depts of the DWP...

Would welcome any thoughts.

They've been doing this with PCA reports (for IB) for years, even where there has been a successful appeal against the PCA decision.
