Help!!!
I am completing a DLA claim in respect of a child who has severe behavioural problems.....but no difinitive diagnosis! Psychologist is unofficially stating ADHD but also mental health problems (no precise diagnosis)as the child is often a threat to himself and his siblings in as much as he expresses suicidal ideation and a desire to deliberately harm his brother. At the back of my mind I recall a CD which dealt with non diagnosis but i cant recall whether it was the Tribunal whose decision was favourable or the Commissioners........Can anyone help?

Hi Margie
Im not sure if the case you are referring to is one heard by Comm Levenson on 9 February 1999 (CDLA/1659/1997. It dealt with the issue of non diagnosis. The Commissioner stated that the statutory test was on the needs of claimants and on their ability to cope without assistance rather than on any specific diagnosis. Four cases were heard at the same time all relating to children with behavioural problems. I dont have an electronic copy but do have it in paper form (although not a very good photocopy) Elizabeth
