Reduced Earning Allowance -Retirement Allowance

Does any one know if the equal treatment argument has been tried regarding the change from REA to retirement allowance for women at 60 while men keep REA until 65 Do you have any views either way?

This issue was recently considered by Commissioner Rowland in CI/1881/2003, and a summary of it, together with a link to the full decision is available in rightsnet briefcase.


In brief, Commissioner Rowland considered himself bound by the negative decision in Hepple v. Chief Adjudication Officer (R(I)2/2000), but has stayed his final decision pending the conclusion of an application to the European Court of Human Rights by Mrs Hepple (although the admissibility of her application had yet to be determined).
