I have client who made a claim for MIG in 03.03 this request was refused as the his wife was alleged to have a notional income of £20000 he appealed the decision. His wife had previously made a claim for IS but was refused because of the capital she also appealed the decision.
The money had been spent on a kitchen (£15000)this was because of a specially designed kitchen because of disabilities she also gave £5000 to her mother who she had an outstanding debt.

Our client went to tribunal and was refused because the tribunal stated that they were bound by the decision of the previous tribunal (ie decision related to his wife, she is at present going to the commissioner).

Should the tribunal have given other reasons for the decision rather than simply being bound by the previous decision. We have asked for the full statement of reason for this decision and want to go commissioners if we can find an error of law.
