r2r, transitional protection and discrimination on grounds of sex
Thu 24-Jan-08 11:04 AM

It's just been suggested that the transitional protection for r2r cases may be questioned under art 14 ECHR, i.e.indirect discrimination due to the fact that more men than women maintain a claim for a prescribed benefit and consequently women are hit harder by the loss of the transitional protection due to marriage breakdown or similar.

Has anyone any cases where this is at issue, a ref would be handy to quote, and hopefully; if you've had time to research it, any evidence...

Sorry to ask everyone else whether they've already done my job for me, but I've not much time on this sub and it's only just been suggested.
