Computation of earnings

Have an JSA appeal where client has had fluctuating work and income.

DM has declared that reg 51(2)(b)(i) of JSA regs applies and has made many assumptions so has averaged earnings.

However the employment is actually a series of discrete, seperate contracts (5 or 7 days long). Gaps between contracts are 0 days, 1 week, 2 weeks, 3 weeks. There is no pattern to this and it is definitely not cyclical.

Have seen cds on fluctuating work for teachers, seasonal and charity workers but do not see how they apply to very short term contracts.

Does anyone know of any cds that would help to show eligible to JSA in between contracts?
