back dating DLA
Thu 05-Oct-06 09:53 AM

Hi... client was on high DLA care for 15 years, husband as carer, he died, DLA stopped. Client has a daughter who took over the carer role, but because she herself is on incapacity benefit she was not capable of re-claiming the DLA for her mother. GP says that the need for DLA would have been continuous. we have re-applied. Can we get a backdate ?

DLA payments may have stopped when husband died, if he was appointee. Did your client's DLA award end then, and for what reason? I would have thought after 15 years she would have a life award. How long is the period you are looking for a backdate?
