ICB Medical Assessments

Does anyone know if there are any regulations allowing ICB medicals to be carried out at a claimants' home? Just won a tribunal where client (who suffers severe depression, such that on regular occassions she cannot leave her home) failed PCA due to 4 non-attendances for such medicals. Clearly, DWP/UATs have to look at the circumstances at the particular time, but I expect cl would fail again with more difficulty convincing DWP/UAT of good cause next time. An alternative for this client is a home visit by DWP's doctors, as with DLA/AA EMPs. But I cannot find anything of help (nor saying this cannot be done).

I dont know of any regulation allowing this but I know that the Medical Services will allow medicals to be carried out in the person's home on the basis of a recommendation from the mental health team or GP.

btw.....have you tried for exemption under the severe mental health aspect of the regs?

Haven't had enough evidence yet where I could try an exemption Sought evidence from GP for domicilary UAT, but got bland reply that hadn't seen cl enough to be able to comment (as cl is often too frightened to leave house). Cl now has CPN input so could discuss with them.

Have you seen DWP guide on PCA assessments at http://www.dwp.gov.uk/medical/ibh/medical-assesssment.pdf

"3.10 Domiciliary visits
Not all Personal Capability Assessments are conducted at the examination
centre. On occasions a claimant will indicate that they are unfit to travel or to
attend the MEC and a domiciliary visit is necessary."

There is then further information about the Data Protection Act when PCA is conducted at home.

Would a blanket refusal not to provide home medicals constitute a breach of the Disability Discrimination Act, and open up several option to challenge the DWP.
