SDP and bedsit

Hi, can anyone please clarify if my client should be elegible for SDP?

Client is 93 years old in receipt of AA higher rate.
She lives in the extension (bedsit) which has been specifically built for my client. It consists of a bedroom, kitchenette; walk in shower and toilet.
Her daughter who is her main carer lives in the main house. She earns more than £95 a week.
I have also requested a discount on daughter's council tax liability.
Please advise.

Here is an example from the DWP Decision Makers Guide at para 23212...

"Anna is aged 52 and claims IS as she is incapable of work. She gets DLA and no one gets CA for caring for her. She lives in a self-contained granny flat attached to her daughter’s house and pays her daughter rent for the flat. She has her own bathroom, kitchen, bedroom and living room. Access to the flat is from the hall of her daughter’s house and the front door of the property is shared. Everything else is separate.
The DM decides that the hall is the only shared area and is a communal area. Anna does not share the accommodation and does not normally reside with her daughter.
She has no non-dependants and is awarded SDP."

One of the factors that can decide in favour of your client, but not necessarily against, is whether there is a separate Council Tax assessment on the extension.

Who does the cooking and cleaning for your client? How independent is she? Does she pay any form of rent to her daughter? Would somebody, looking at them objectively, say that they were living in the same household?
