Does anyone know whether the agencies in CTC/2608/2008 have appealed, I note Comm'r Jacobs granted leave in his decision.

I'm carrying a case analogous to CTC/4390/2004 where mum's got a higher award than dad would otherwise get, although Dad's pleading poverty as he's got eleventeen kids in the new family. Dad's already been touting HRA arguments about, albeit evidently with no knowledge of the 99 Act actually works, but with the recent decision, if he sppots it, things might get more complicated than I'd hoped!

The commentary in the Briefcase section says that it is to go forward as Humphreys vs Commissioners for HMRC so I assume the appeal is under way. I have a case stayed pending this case. I've not heard from the Upper Tribunal since the Jacob's decision and I assumed this was because the appeal is considered to be going ahead.

While the outcome in CTC/2608/2008 doesn't surprise me, the reasoning seems very strange. I suspect the judge didn't want to make the final decision on this so came up with something that would definitely be appealed.
