appeal with supersession and renewal
Thu 13-May-04 10:58 AM

can someone help me clarify this one?

client shortly has a DLA tribunal based on his own supersession request (looking for mobility component and increased care component). before appeal has been heard, client put in another claim (treated as renewal claim) where the existing award of LRCC was extended. Client asked for a review, decision was maintained and then client failed to appeal.

Can the tribunal supersede both decisions or only the first one?

I have to say I have a worrying tendency to go cross eyed when I start thinking about those sorts of scenarios even though they happen more often than I would like. I've had similar cases where the appeal succeeded and DLA paid the increased rate without a murmur and other cases where I've ended up with a limited award. Personally, I'd err on the side of caution and lodge a late appeal against the review decision and ask for both appeals to be heard together.
