She still counts as a dependant of an EU national until after the divorce (as long as he remains in the UK). She can claim benefits on that basis.

If he leaves the UK she is in trouble.

After the divorce, she cannot claim benefits on the basis of her EU status. She also loses the right to live in the UK.

So, unless she is given permission in her own right, on other grounds, to stay in the UK or cliam benefits, she will fall outside of provision then.

You do not say what her immigration status is outside of her EU connection. That may change the above advice.

She will need to seek immmigration advice as well.

Hi and Thank you caseworker from Kensington North,

Her status is non outside the UK or outside this marriage. In the rest of EU she is a visitor on 90day Visa stay in 12months but must then return to UK or to UA.

Thanks
Peter

I am not too sure if you can reply this one too, its an immigration matter.

A Ukrainian student presently studying in UK, has an offer to become a partner in a business of her Step-Father at the end of her Student Visa in May 2005 or sooner.
What are her chances

Thank you
Peter

It is indeed an immigration matter, and I can't help you with it I'm afraid.

Both of these people should go and see an immigration solicitor.
