Pre-hearing enquiry forms

Hi,

Just had my first funny with a pre-hearing enquiry form - JC+ sent out a submission to us with letter saying that client would have the TAS1 with his copy. Client did not have the TAS1. We called JC+ and they said actually the Tribunals Service would be sending it, but when we spoke to the Tribunals Service they hadn't.

Might be worth checking if you've received submissions in the last week ...

The Tribunal can't send out the enquiry form till it knows there has been an appeal, which usually happens at the same time as the client gets their copy of the submission (or response, as we must now learn to call it...)

Yes, that's what I thought, but actually the Tribunals Service said that it should have been sent a few days ago but it just hadn't, not for any good reason. My guess is that the computer said "no".

I had two sets of submission papers this week for clients with the standard covering letter saying the claimant had the TAS1 with their set of papers and that it had to be back in 14 days. As is correct under the new rules the clients did not have TAS1's at all.I rang the Tribunal Service to check that they were sending them out and they just hadn't got round to doing it. I rang the DWP and told them that the old covering letters were no longer appropriate and they said they would feed this back to the relevant section. This was DLA but obviously other sections haven't changed their standard letters either. Hopefully they will catch up with themselves!!

Also, just spoke the the Birmingham ASC and they say they have sent out a number of reminder letters in error to clients who have not been sent a TAS1 yet.

The person I spoke to was very helpful and apologetic, but I do sort of feel that if it ain't broke ...
