Dividend payments
Fri 05-Oct-07 09:38 AM

I want to know if dividend payments are treared as income or capital for Income Support purposes. The shares have no market value as they are from a private company and none of the other shareholders wish to purchase them.

Actual income from any capital is disregarded for IS, and the tariff income rules applied instead: para 22 of Sched 9 to the Income Support Regs (income disregards) and Regulation 53 (calculation of tariff income).

"The shares have no market value as they are from a private company"

My company law is hazy to say the least but a private limited company may not be able advertise or float its shares but that doesn't mean they don't have any value.
