Rapid Reclaim
Mon 14-Dec-09 05:43 PM

Right....We know that if someone was in receipt of IS, JSA, IB or ESA and claiming HB/CTR then started work and reclaim within 26 weeks for IS, JSA, IB or 12 weeks for ESA they can complete a rapid reclaim (HBRR1) and if no other changes in their circumstances their claim for HB/CTB can be reinstated.

Usually cases are JSA(IB) ceased, started work, ceased work, JSA(IB) reawarded.

But what if JSA(IB) ceased, started work, ceased work and either ESA or JSA(C) is reawarded......Is the Rapid Reclaim still valid ?

Any thoughts, comments or legislation quotes greatly received

Thanks

Depends a lot on what a particular La has classed as a "claim", not withstanding rapid reclaim.

Some La's allow shortened claim forms, maybe even a letter in such circumstances.

If the La has not decided what they will accept as a "claim" then all this becomes arguable wherever there is a period with no entitlement to hb/ctb.

And, as to what constitutes a claim has recently been the subject of a Court of Appeal judgement.
