Posthumous D.L.A. Special Rules Back-dated claim?.
Wed 15-Nov-06 01:43 PM

Is it possible to make a posthumous claim for an increase under the Special Rules, with a request for back-dating. I know the back-dating bit could be achieved under the circumstances, but what I am less sure about is whether a Special Rules application can be made posthumously, in the following circumstances:-

A Ds1500 Report had been requested over the telephone from the G.P. about a month ago. This appears not to have been sent through. Is it possible to request a DS1500 Report from the G.P. again, , given that the G.P. is a person empowered to make the claim on behalf of the claimant under the Special Rules?. Is there any scope for such action?.

Thanks for any replies you are able to give.

John.

Sorry to appear a bit Mr. Bean-ish and reply to my own message, but in case anyone else wonders about this, I have looked into it further and think that Reg. 30 of the C+P Regs 1987 appears to provide the answer. Reg 30(5) appears to provide that a claim may be made posthumously to any benefit (other than those specified), subject to various sub-paragraphs none of which refer to D.L.A.. I am going to make the application, which, is strictly speaking a supersession as opposed to a new claim. If anyone forsees any problems please let me know!.
