Any possibility of client getting IS?
Thu 10-Sep-09 09:48 AM

Hope someone can think of a way I an get my client onto benefits, she has failed medical and ESA stopped, have appealed this but her main condition is sciatica for which she has no treatment so unlikely to to win appeal. Client is 58, has not worked since she was 21, she cared for husband for the last 20 years and he died about 15 months ago.(don't have any med evd supporting depression for appeal either) She lives in rural area with bus once a week and cannot drive so would have to place too many restrictions on availability for work for JSA. Thought she would fall into prescribed category for IS because she is over 50 and not worked for last 10years or over 55 and spouse has died but have looked these up and regs state these were revoked in 2006. She has small occ pens from husbands work but no other income, Help!!!

She may not have so much difficulty in claiming JSA. There's a travel restriction of 1.5 hours each way, and as she would have to use Shanks' pony, that's 4.5 miles at average walking speed, which would seem to be a reasonable restriction, notwithstanding her sciatica, which I hope would make it less.

And why do you think lack of treatment for sciatica should lessen chance of positive appeal outcome? Activities 1-3 could accrue sufficient points, based on restrictions on mobility through the effect of pain. Was sciatica put down on ES50?

ESA should have been put back into payment following appeal.
