overpayments and time limits

have client who is 6k plus in debt on meals on wheels. Apparently, has not heard from Council for a couple of years and now has Bailif's letter. No possessions any way, but, does anybody know if there is any challenge on time limits...

Who are the bailiff firm..


Certificated bailiffs collect for unpaid taxes and Fines etc..

County court bailiffs for debts which have been through the county court system.. Cli would have received a claim form and several other letters from the creditor to inform about this action (unless recently moved)

However, I have seen an increase in certificated bailiffs (private bailiffs) also now acting as debt collectors.. However their letters to 'debtors' are very ambiguous and do not specify that in this instance they are only debt collectors and not acting as bailiffs..

Meals on Wheels is not a debt that could be collected by certiicated bailiffs... So its either county court bailiffs (look at asking the courts for a variation order on N245) or its certificated bailiffs using their debt collector hats (and scaring the general public senseless..)

You need to determine this to decide on course of action..
