Appeals and new claims
Mon 07-Jun-04 04:06 PM

Sorry if this is a silly question.

Appeal in progress, new claim made in case it fails.

Can the DBU always stockpile the new claim until the appeal is decided? On what grounds/reg?

In my experience they don't, unless you want them too that is.

DBU will probably decide new claim, then appeal will relate to closed period ending on date of new claim. Blackpool told me I could not have overlapping claims in this way. I had to ask for new claim to be treated as a request to supersede the previous decision which was being appealed, even if this had resulted in a nil award. I wasn't totally convinced but in practice it made no difference.
