Remunerative work and suspension

This seems like a 'stupid' question, but for JSA purposes and WTC purposes is someone who is suspended from work in 'remunerative work'?

A further complication for the particular client is that he is suspended on full pay but is not being paid (cheques bouncing).

Hi Tony

The condition for JSA and WTC is engaged or treated as engaged in remunerative work (regulation 51 of the SSA Regulations). There is no provision as far as I am aware for treating him as engaged while suspended. For JSA I don’t think that a person can be said to be engaged in remunerative work while suspended but would probably not be available for work while under contract to his employer.

A person suspended is treated as engaged in remunerative work under regulation 7B of The Working Tax Credit (Entitlement and Maximum Rate) Regulations 2002 so WTC should continue for the period of the suspension.
