bangladeshi couple ...
Thu 17-Dec-09 01:02 PM

good afternoon good citizens !
have a couple who are bangladeshi, the woman has british citizenship but the man is an asylum seeker.
they have just had a baby.
man has papers stating he has to reside at a certain address but couple want him to move in with wife and child.
my concern is that if he does this will affect mother and childs benefits and it may also affect mans appl. for indefinite leave to remain ?
any thoughts greatly accepted ...

my recollection is that it should not affect HER benefits for herself or the child, including CB/CTC, since she would have been entitled to them anyway; indeed, i even read the CA saying precisely that recently but can't for the life of me remember which case they said it in...

The point has been discussed previously as well and people came to that conclusion.

however, as to affecting his position, he would need specialist immigration advice as to that.
