Hi,

Please Help!!

I have a client who is a Dutch National in reciept of Dutch Disability Benefit (this is apparently equivalent to ICB/ESA) of approximately £840 per month and she also works 6 hours per week. Her husband is an Indian Natiional on a Work Visa which runs out in a few days and they have applied for a Spouse visa and not heard yet. He currently earns £800 per month. They already have one child and second child due any day, therefore she will not be able to continue work.

Mrs has applied for Child Benefit and CTC is awaiting a response.

Mrs also applied for HB/CTB which has refused on the grounds that she has little or no employment prospects due to her disability and that her husbands's stay is not permanent.

Can she claim to be self-sufficient??
Any other grounds for an appeal?
