Joint claim or single claim?

Hi all,

Just wanted some opinions on the following if anyone can help.

I have a client who I have advised to make a claim for CTC. She has been employed by her husbands Ltd company but the business is struggling and client stopped working there some months ago. Couple have a 2 yr old son and have not claimed TC's before.

Now, due to their financial problems, couple have let their home to tenants and have moved back with family. Client and son have gone to her parents and husband has gone to his parents. Client reports they are very much together as a couple but cannot live together as there is not enough space with either set of parents. So, if client makes a claim for CTC whilst she and son living with her parents, does she just make a single claim?

For tax credits, if a couple are married, they must make a joint claim unless they are separated in circumstances likely to become permanent or separated under a court order.

It doesn't sound like your couple are either of those, therefore I would think they need to make a joint claim.
