Any ideas on this would be appreciated.

Couple both in 70s on G PC. Care for adult daughter with learning disability.

Mrs is getting a carers premium for the daughter. Mr has just been awarded AA. I advised that Mr claims the carers premium for the daughter, allowing Mrs to claim a premium for Mr - giving them a double premium.

After these new claims had gone in I discover that Mrs has one of these protected carers premium from a pre 2002 ICA claim for caring for the daughter.

My question is by switching the claims will her protected pre 2002 premium be lost forever - or can she re-claim it in the future if their circs changed?

(PS anyone going to nawra at Chesterfield on the 27th?)

Hi Jane

As long as she still meets the residence and present conditions she will retain her entitlement for CA for life, even if she no longer provides care.

Because of the circumstances I would advise Mrs to advise CA unit that she no longer provides 35 hours care for daughter, Mrs not to claim CA for husband (to keep the old CA entitlement). Mr to then claim CA for daughter (providing the caring responsibility does not contradict the reasons for him being awarded AA). This will result in double carers premium.
