Incapacity medical - duration ruled to be a relevant fa...
Tue 17-Feb-04 03:05 PM

We've just received a decision of Commissioner Parker (CSIB/69/03), which I'm about to post to Shawn Mach for publishing on RightsNet. With regard to the mental health descriptors, Mrs Parker's view is that the duration of the interview and examination, while not determinative in itself, "surely it may be relevant as an indicator that the examination was not properly conducted."

Hopefully Shawn will be kind enough to publish this decision in due course.

In reference to CSIB/69/2003 - the decision makes reference to two other CSIB/450/03 and CIB/0908/2003. However it would appear that neither of these has been uploaded to the OSSCSC website yet.

Does anyone have a copy of these decisions? Or can provide a summary of them?

Cheers.
