I'm having difficulty finding anything in CPAG re the time which people who fail a WCA have to wait before being able to reclaim ESA on the basis of the same condition. If the same six month rule applies as it did for IB/IS, does the six months run from the date of the department's decision on the previous claim or, if an appeal has been lodged, from the date of the first-tier tribunal's decision (bearing in mind that ESA will usually have been paid in full up to that date).

Its the same as for ICB (reg 30 ESA Regs) and the 6 month period runs from the date that the decision on non entitlement following the WCA is notified to him by the DWP.
