SSP with IS top-up

Hello All

I've seen a thread discussing the continuing entitlement to IS when SSP ceases on the grounds of a change of circumstances rather than a new claim. However I'm damned if I can find it!!!!

Had some discussions at work about this, particularly in relation to the drop in income. So is some kind person able to direct me to the thread or let me know what the outcome was?

We've been thinking on the lines of a test case to check it out.

I cannot help with the above but I am interested if there is a possible challenge.

Most of my clients are terminally ill so they supposedly slip neatly onto the support levels of esa without the assessment period and therefore have a higher level of benefit on going from ssp with is top up to esa (if they are single that is).
What actually happens is different of course (re all the posts above about delays and ignorance in assessment) and so far a smooth tranistion has not applied.

But that is not the point of this post. I am just helping my first client with the transition who is not terminally ill. She is - but has a long prognosis. She gets middle care dla. So she is going from ssp and is with sdp to basic esa with hopefully sdp. I have advised that her income will drop substantially for the next 3 months then will go up again and be just under £2 less than it is now. I have advised a complaint to her MP but if there is another challenge she will be up for it.
