tax credits, single claim / couple claim

i have a issue where the client did not notify Tax Credit office regarding her partner going abroad and not claiming as single.

clients understanding of being single is being seperated due to relationship breakdown, her partner went abroad, they still have relationship as husband and wife.

Has anyone had similar issues , please advice if there is a way of challanging this decision.

The client’s partner will still be treated as if in the UK for the first eight to 12 weeks – depending on the reason for going. After this time whoever stays behind in the UK will need to make a new single tax credits claim.

It is a reportable change of circumstance.

As far as I know there is also a £300 penalty for not informing them, though I have not seen anyone incur the penalty.
