Would be grateful for a copy of this decision if anyone has it. Appealing an IS overpayment for someone whose mother gave her the money to cover mortgage capital costs not covered by IS. DWP regarding as capital because it was given in a lump sum, not as regular payments. DWP are using R(IS) 2/93 in their defence, presumption of advancement as opposed to a trust.
Any input appreciated. Have to prepare submission this week
