I don't have the one you're after and I suspect you already have seen some of the others. On the offchance one or two has passed you by, do CH/3777/2007 or CH/0117/2005 assist? Others that I am aware of (quite possibly from your own posts!) include:

CPC/0683/2007
R(SB) 2/87
CIS/11441/2005

The housing benefit and pension credit decisions are useful, but I was hoping to see whether Mr Commisioner Levenson had gone further as to how much or little weight needs to be given to emotiional disharmony

My case invloves a funeral payment. The claimant was his late father's carer. He has been refused a funeral payment because his brother is not in receipt of a qualifying benefit.

The brother lives on the other side of London, and he cares for their mother. The mother and father were divorced. The brother has stated that he was in contact with his father but did not have very much contact with him.

The decision maker has stated that the brother was not estranged from his father, and my argument will be that the circumstances surrounding the brother's caring for the mother did lead to him being estranged from his father

One of the best decisions on estrangement is CIS/4096/2005 which rounds up most of the relevant case law including Commissioner Levenson's decision.
