My case invloves a funeral payment. The claimant was his late father's carer. He has been refused a funeral payment because his brother is not in receipt of a qualifying benefit.
The brother lives on the other side of London, and he cares for their mother. The mother and father were divorced. The brother has stated that he was in contact with his father but did not have very much contact with him.
The decision maker has stated that the brother was not estranged from his father, and my argument will be that the circumstances surrounding the brother's caring for the mother did lead to him being estranged from his father
