My client's employment ended on 31 March. Her normal payday was the 30th of the month. On 30th March, she received a month's SSP and 23 days' holiday pay. Her twelve weeks' PILON was not paid until 30 April, together with a final week's SSP.

Can someone confirm that my reading of the regs, ie that her PILON will be treated as income on her HB/CTB claims for twelve weeks after she received it, as opposed to twelve weeks after she finished work, is correct?

Thinking this through as I'm writing it, I suppose that even if her PILON had been paid on 30 March, she wouldn't have been much better off owing to the rule which has it that Holiday Pay and PILON periods are added on consecutively. And had she thought to claim benefit between the 23rd day after her Holiday Pay was paid and the date she received her PILON she would have been no worse off at all.

Very simply, any PILON / holiday pay / SSP should be taken into account for the period it is in respect of, irrespective of when it is actually paid.
