Work Focused interviews
Fri 13-Aug-04 01:39 PM

I've a client who is a lone parent with one 14yo dep. client on IB and LRC DLA. We are assisting with supersession and I have requested an IS form in case she is awarded MRC and thereby entitled to sdp and therefore IS. They will not send her an A1 form without her agreeing to attend a WF interview. Is this mandatory in this case ?
Thanks
Sue

Why don't you just download an application form via the DWP Website?

I don't know however whether they will call her for an interview if she is successful in being entitled to IS

It is unlawful not to supply a claim form under Reg 4(5) of the Claims and Payment Regs 1987.

A claim for IS, once submitted, is not complete unless a work focused interview is attended, or waived as the case may be.

If a claim form is requested and the claimant indicates that s/he will not attend a WFI then it is up to a benefit officer to warn the claimant of the potential consequences of refusal to comply but a claim form cannot be withheld.

A word with the officer's supervisor usually does the trick.

Regards
Paul
