I had been reading the post in the Disability Ben on SDA and CA and presto I get an overlapping bens on my desk. Hopefully this is a straight forward one. I just would like re-assurance that I am correct

Scenario is Mr will become 65 and will claim his RetPension when Incapacity ends Mrs is aged 63 and in receipt of SDA at £52.75.
They had already been topped up with guarantee credit and on my calculation they should also become entitled to £21.25 weekly savings credit be it not that the SDA prevents this because it is not a qualifying benefit for Savings Credits.

So I think that Mrs could claim Ret. Pension as married woman and will than be paid the £50.50 topped up with £2.25 SDA in accordance with the Overlapping Bens regs Reg 4 par 5(a)
and at least the greatest part of the Savings Credit becomes payable

I think this is not deprivation because contributory benefit should be claimed in preference to a non contributory benefit

So, I hope I am right and I also wonder if the Pension Service advisers are actually identifying this and advse accordingly?

As said this was the first one I came accross but maybe it is run of the mill ?

I confess my ignorance where pension credit is concerned, but I agree with your assessment. If the state retirment pension is more than SDA, then there will be no top up, although I guess from the figures you give you already know the exact SRP?

Deprivation rules cannot apply at all in these circumstances. Operation of the overlapping benefit rules is not a deprivation on the part of the claimant.

I wouldn't have thought there would be no problem with adjusting the PC to include savings credit. It would be a standard change of circs once you know when SRP becomes payable.
