posponements/domicilliary hearings

Have just put in a request to TAS for a postponement of a hearing, but also preferably a domicilliary hearing for DLA. Am still waiting and chasing medical reports from 2 consultants, hence the postponement, as insufficient medical evidence yet. Client is 64 and very immobile- only able to walk to the toilet in her own home, and not at all out of doors, hence application for dom hearing.

But.. first time I've done this. Can anyone give me any pointers about what to do if refused, or even advise as to how commonly these requests are accepted? And how soon should I expect to hear from TAS? (The appeal date is set for 17/08/04).

I've only got domiciliary hearings with medical evidence to show need for it (although you may already have that on the papers). If you've requested evidence I hope what you've requested will cover it. Then you can submit your evidence and request in one go when the hearing has been postponed.

17/08/03 is a while away - is that a booked or prebooked hearing? If it's the latter then you may not get notification that it's been put off because it doesn't actually exist yet. It's probably best to just keep speaking to the clerk on the phone to see where your applications are. A clerk won't usually refuse a postponement request - they'll pass it on to a judicial member if they think it's dodgy and usually all domiciliary decisions are made judicially as far as I've ever heard.
