receiving child benefit for IS purposes

Hello, got another another Child benefit / IS question.

I have a client who has been refused Income Support as a lone parent as the Child Benefit claim turned out to be in her former husbands name. However it was being paid into a bank account which is in her name only.

Is there any milage in arguing that she was 'recieving' it for the purpose of IS reg 15(2)(a), even though she was not the named claimant? I wasn't sure whether the reg was meant to be read literally, or if recieving was meant to mean claiming in this context.

Sorry if this is basic stuff, but I have not come accross this before.

In CIS/2317/2006, it was found that Child Benefit belonged to the person payment is for, not the person receiving it.
