I have a client whose mom aged 99 has been in residential home for 9 yrs and with the local authority paying some fees and rest coming from moms pension credit less the personal allowance, my client who is on pension credit herself has been paying the top up fees which now cost her £25 pwk but her savings have now almost gone and she can no longer meet these payments. It seems as though she cannot be held liable for this payment since liable relatives rule was abolished from april 09 is this right. It seems that home could take court action against resident for non payment or LA could decide to move mom to cheaper place, but would have to assess effect on her this may have.
Has anyone else had this issue and what tactic did you employ to convince Social services they should pick up the extra costs.
