length of time taken to provide written statement of reasons
Tue 18-May-10 12:22 PM

I know the answer to this is probably in the depths of this topic, but as I'm lazy...can anybody point me in the direction of the caselaw about how long 'judges' should take to get their written decisions back to reps? I've been waiting three and half months for a decision from a judge (who told me to 'shut up' during a hearing) and am itching to get my hands on it. Is this an acceptable length of time or I am just being impatient...?

Neither.

Where is your TTS admin office? Birmingham?

In what context did he tell you to shut up?

They had lost my written submission so I asked the Judge to let me outline what rates we were asking for and why. I was told to 'shut up. Your client is more than able to speak for herself'. Error of law anyone?!

Probably. It is a breach of natural justice not to allow a rep' an opportunity to put the best case for his client unless there is some other overiding judicial principle or interest for not doing so.

No, it's Cardiff (who, according to the Tribunal User's Group this morning have seen their cases jump from 8,000 to 22,000 per year since the intro of ESA)

The Tribunal Service should send the statement of reasons within one month of the request or as soon as reasonably practicable after that.
Try writing to the Tribunal Service asking why it has not been reasonably practicable to send you the statement of reasons, if no response, make an application direct to the upper tribunal and see what happens.
