Defective claims - right of appeal
Fri 19-Mar-10 12:40 PM

My understanding is that there is no right of appeal against 'defective claim' decisions (sch 2, para 5(f) D+A Regs).

I've been told by our new claims manager at the local office that "evidence requirement is now appealable".

Have I missed something....?

Thanks,

R(H) 3/05. I think it is highly unlikely a UT will find there is no right of appeal against a "defective claim" decision.
