Industrial Injuries Benefit : PTSD - qualifying disablement?

I'm not well versed with IIB and can't seem to find much literature on it, so thought I'd throw this into the forum:

An employee (nurse) was attacked in her workplace (hospital) by a patient. She is still employed in the same capacity however she now suffers with Post Traumatic Stress Disorder as well as back pain. Her symtoms don't prevent her from doing her duties but they do make these duties more difficult and also effect her personal life (PTSD especially).

Would his type of injury merit a claim for IIB. I'd be grateful for any feedback. Cheers.

I would have thought it to be worth a try - if the back problems a result of the assualt she may also get some percentage points for those as she may have some degree of loss of function.

In terms of the PTSD you would have to show the loss of function she has suffered as a result of this and that the PTSD is linked to the assault in the course of her work.

In trying to build up points you would want to look at such things as anxiety, depression, her ability to go out alone, loss of confidence etc. The hardest thing in cases like this can be getting to the 14% threshold. The fact that she is still working should not make a difference though you would want to show any changes in duties or things she no longer does - i.e. she may not see patients on her own.

I would certainly go for it.

Thanks for the advice Derek, that's really helpful. I suspected the 14% threshold might prove a challenge. I'll give it a go - nothing too lose!

Remember it is still worth it even if she scores less than 14% .It may prove useful if she has any future injuries which can be added to it. Or if current illness deteriorates at least the starting point has been established.

Have you thought about the NHS own scheme
