Does anyone know of any regulation which prevents a lone parent who is a registered childminder working at least 16 hours from claiming both WTC (and CTC) AND Income Support? I am thinking of situations where their income from Tax Credits, CB and a third of their net earnings does not take them over their applicable amount for Income Support because they are entitled to IS housing costs after a waiting period. My thoughts are that it is possible because the claimant could be treated as in full time work for the purposes of claiming WTC (because they are working 16 hours), and not in full time work for the purposes of IS (because of the regulation which says a childminder can be working any number of hours). Some other groups can in theory get both IS and WTC, for example 'term-time only workers' during the holidays where they will still get their WTC but no earnings so can get an IS top-up. But I've always been under the impression that childminders have to choose between WTC or IS, and yet I can't seem to find anything which stipulates this, and I recently did a calculation for a childminder, using IBIS (Intergrated Benefits Information System) which gave an entitlement to both WTC and and IS top-up for housing costs. I'd appreciate any feedback.
