I understand that either an EAT award or a compromise agreement, ie a settlement negotiated before the hearing, would be liable for income tax at the client’s marginal rate, subject to a £30000 disregard, and that the amount would be taken as income in the tax year when the award was made even if the loss of earnings had been incurred over more than one tax year. Would the award or settlement be treated in the same way for CTC/WTC purposes? Would the £30000 disregard still apply? I can't find any guidance in the TC Technical Manual.
