loads of stuff about what to do when claimant is said to have deliberately deprived themselves of capital....... but has anyone any ideas about what to do when the DWP say that a claimant still has the capital? The local office has turned down an income support claim saying that the claimant still has the £12000 which was shown in his bank account a year ago. Claimant says the money was not his and it was withdrawn and returned in Feb 2004 to a friend who has moved to America leaving no contact details. An appeal the money did not belong to him was lost. The local office say that they can refuse claims indefinitely unless they have proof that the money has been disposed of. My customer cannot provide any proof and he has now been without benefit for a year. This seems ridiculous and unfair: had he said at the outset that the money was his but he had thrown it in the river in order to claim benefit, he would be back on income support by now. Ideas please?
