PCA appeal tribunals at home?
Mon 06-Dec-04 07:42 AM

My client is immobile and would like the appeal against her PCA decision that she is capable of work, to be held at her home.

Are they likely to entertain this request or will we be forced to accept a paper hearing?

What degree of immobility is demanded for home hearings should they happen?

Thanks for your help.

We've arranged a number of home hearings, mostly for DLA and AA though. In all cases we have needed a GP letter to back up the fact that the client cannot get to an oral hearing elsewhere.

We quote "rules of natural justice" and "right to a fair hearing" when requesting home appeals.

Must admit i've never actually checked if there's any legislation as we've never needed to!

Good luck

Nicky

Dan,

I posted a request very similar to yours a few months ago on rightsnet, (though I was 'on the other side of the fence - i.e. looking to make the request as a local authority, in a HB case), but I had some very good replies...

As it turned out, I never needed to make the request as LASA took up advocacy for the appellant...

However, you might find the thread (and the case law cited), as useful... the thread is at:
