ESA & SSP(joint claim)
Just clarifying something.
I advised a client who is on SSP(suffering from anxiety)- the SSP is the only income they are getting apart from her PIP that since his wife has a serious health condition(she is in receipt of enhanced rate PIP daily living) that rather than claim IS to make a joint claim for IR ESA as his wife as the main claimant. He was also advised to apply for CA for her to avoid WFI.
I tried to find this in CPAG but can’t find the reference- as I am worried that the no ESA when claiming SSP rule might come into affect- but this is a joint claim in his wifes name-so I thought that this rule would not come into affect-although I can’t find this in CPAG to justify my thinking.
Could someone clarify this for me?
Thanks
A
Would they not be better off on IS rather than IRESA?
