ESA and frequent seizures
I have a client that has epilepsy and suffers frequent seizures (at least 2-3 per week). I’m about to complete his ESA50 and think it’s worth arguing that as he has no warning of the seizures, and has suffered several injuries as a result, meets most descriptors as he cannot be considered able to perform tasks safely.
Has anybody tried this argument? Is anybody aware of relevant caselaw for this?
