Anxious scrutiny was a judicial device (as opposed to a fully formed legal doctrine) developed largely in human rights cases, before the enactment of the Human Rights Act 1998.  It has largely been overtaken by the concept of proportionality contained in that Act.  There’s an excellent, recent discussion here which requires no further elucidation from me.
