Hello,
My client has a PC overpayment of £14k which arose from him not declaring his occupational pension.  He is not disputing the OP.  His PCg has now reduced to £23pw from £66 and he is worried about further deductions when debt management start recovery.  He has not incurred a civil penalty so I believe I’m right in thinking maximum deduction from PC will be £10.95pw.  My question is; can they make deductions from his occupation?  I’m sure I saw this happen recently in an ESA OP case.
Thanks

Deductions from his occupational pension? I should think that would require a court order. CPAG p.1228 states £10.95 in non-fraud/adpen cases.
