Outstanding IB appeals

Has anyone else got any outstanding Incap appeals?

I have one that until recently was mired in administrative difficulties within CTS and I’m wondering whether I’ve got the dubious honour of the last ever IB appeal.

I suppose someone’s been trying to find a legal book that covers it and a judge who has been trained to deal with it.

I’m glad to say that there’s still a few Judges round these parts who will remember how it works. It’s a domiciliary (hence the administrative problems) so I’m likely to see someone senior.

I wonder whether they’ll know?

For the avoidance of doubt; this case is only three years old. It is the rehearing of the appeal in CIB/2688/2012. It got mired due to a change in procedure regarding domiciliary hearings at HMCTS.

I do hope that it’s the last because it will be a nice feather for my cap; however I do not intend to publicize the situation as a basis to criticise HMCTS as there are sound operational reasons why it got mired.

I don’t believe that it is unusual that cases that have gone to the Upper Tribunal are as long in the tooth as this one.
